Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The situation originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was detained in federal detention.

In her decision, the judge noted that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal proceedings center on disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.
